1. What is the Town's Level of Service Regarding Maintenance of The Drainage System?

The Town's level of service regarding drainage system maintenance is detailed in the latest adopted Stormwater Drainage System Management Policy (October 27, 2011). The summary of this document is as follows:

The Town of Farragut is responsible for the administration and enforcement of stormwater and drainage management regulations and associated inspections, including maintenance of the stormwater and drainage system located in public rights-of-way along public streets and other public lands. Additionally, the Town is responsible for the administration and enforcement of floodplain management regulations and associated inspections.

The Town of Farragut is not responsible for the maintenance of stormwater and drainage features located on private property nor within easements on private property.

Private property owners are solely responsible for the maintenance and upkeep of stormwater and drainage features located on their property. Said stormwater and drainage features include (nonexclusively): a good surface cover such as grass to minimize erosion, drainage easements, pipes, open grass swales, detention/retention/sediment basins, oil/water separators, rainwater harvesting systems, pervious paving systems, rain gardens, proprietary water treatment devices etc.

THE TOWN OF FARRAGUT RESERVES THE RIGHT TO DEVIATE FROM THIS POLICY FOR THE HEALTH, WELFARE, AND SAFETY OF THE COMMUNITY

2. How Do I Report Illegal Dumping Into The Storm Sewer System?

The preferred method of reporting an illicit discharge into the storm sewer system is to submit the issue as a request online via My Government Online. If you do not have access to a computer, you may call (865) 966-7057 and ask to file a citizen's request.

3. Who Needs A Grading Permit?

Every person shall be required to obtain a grading permit from the Town when a site plan is required per the Farragut Zoning Ordinance or when a preliminary plat is required per the Farragut Subdivision Regulations. An application for a grading permit shall be submitted during the process of applying for either a site plan or preliminary plat.

4. Who Needs An Aquatic Resource Alteration Permit (ARAP)?

Any persons who wish to make an alteration to a stream, river, lake or wetland must first obtain an ARAP. Examples of stream alterations that require a permit from the Tennessee Division of Water Pollution Control (division) include:

» Dredging, excavation, channel widening, or straightening
» Bank sloping; stabilization
» Channel relocation
» Water diversions or withdrawals
» Dams, weirs, dikes, levees or other similar structures
» Flooding, excavating, draining and/or filling a wetland
» Road and utility crossings
» Structural fill

5. How Do I Appeal A Notice of Violation (NOV) or Civil Penalty Assessment?

Pursuant to the Tennessee Code Annotated, any person aggrieved by the imposition of a civil penalty or damage assessment as provided by the Town of Farragut's Stormwater Ordinance may appeal said penalty or damage assessment to the Stormwater Advisory Committee (SAC). Appeals should be made in writing to the Town Administrator within 30 days of being served with the damage assessment of civil penalty. Failure to appeal shall be deemed as consent of the violator to the damage assessment or civil penalty and it shall become final.

The Stormwater Advisory Committee (SAC) meets every second Thursday of the month at 3:30 p.m. at Town Hall.

6. Is It Ok To Discharge My Pool Over My Lawn?

Section 14-502 of The Town of Farragut's Stormwater Ordinance specifically excludes swimming pool discharges as an Illicit Discharge as long as the water is dechlorinated (typically 3 parts per million / ppm chlorine).

Some things to keep in mind before emptying your pool:
- chlorine should be allowed to dissipate for a few days prior to discharge
- discharge should be in a grassy area, as far away from waters of the state (Turkey Creek, Little Turkey Creek or Fort Loudoun Lake) as possible
- rate of discharge should be such as to maximize infiltration into soil without forming a point source and
- no soil erosion should occur.

This policy applies only to pools that use chlorine as a disinfectant. Other disinfection products are not covered by this policy. Discharges from pools that use other disinfection products must either be routed to a sanitary sewer, or obtain a no-discharge (land application) state operating permit or point source discharge (NPDES) permit.

So in short, yes, it is allowable to discharge your pool over your lawn. Just make sure you let the chlorine dissipate for several days before doing so and make sure the discharge is slow and steady to optimize infiltration.
